Human rights do not cease to exist during war, although often under particular threat at that time or simply ignored on the basis of military necessity. From 1864 onwards, it was accepted that there was a category of persons whose rights as human being must be respected and protected in time of war, and that to ensure such respect and protection was the duty of states under international law.
